Data protection information for applicants
Information for applicants in accordance with Art. 13 of the General Data Protection Regulation (GDPR)
Compliance with data protection regulations is a high priority for our company. We would like to inform you below about the collection of your personal data by us:
Controller:
The company to which you have applied is responsible for data processing, i.e.
telent GmbH
Gerberstraße 34
71522 Backnang
Phone: 07191 -900 0
E-mail address: info@telent.de
Data required for the decision on the establishment of the employment relationship:
As part of the application process, we process data from you that we require to decide the establishment of the employment relationship. This includes in particular, your contact details such as your name and address, as well as other data related to the application, such as your CV, certificates, qualifications, answers to questions, etc. If you submit an application for reimbursement of travel expenses, we also require your bank details. The legal basis for the processing of your personal data arises from Art. 88 para. 1 GDPR in conjunction with § 26 BDSG.
If you also voluntarily provide us with your personal data, we will process it on the basis of your revocable consent in accordance with Art. 6 para. 1 sentence 1 lit. a, Art. 7 GDPR in conjunction with § 26 para. 2 BDSG.
Sources of the data:
We process the personal data that you provide to us as part of the application process. We also process personal data that we have legitimately received from third parties (e.g. recruitment agencies).
Data erasure:
If there is no statutory retention period, the data will be deleted as soon as its storage is no longer necessary to fulfill the purpose for which it was collected and processed or the legitimate interest for storing your data has ceased to exist. If you are not hired, this is usually the case no later than three months after the application process has been completed or after receipt of the rejection. We will also delete your data if you withdraw your consent to the processing of your data.
In specific cases, certain data may be stored for longer (e.g. travel expense reports). The duration for which such data will be stored then depends on the statutory retention obligations, which may result from the German Fiscal Code or the German Commercial Code, among others, and may be between 6 to 10 years. We may be required to store your data for longer if further processing is necessary for the assertion, exercise or defense of legal claims after we have weighed up our interests.
Recipients of your data:
We will of course treat your data confidentially. Your data will only be forwarded internally to offices or departments that are involved in the specific recruitment decision. We only transfer your data to other recipients outside the company if this is necessary to fulfill our contractual and legal obligations. This may be the case, for example, with banks (for reimbursement of travel expenses) and/or the employment agency.
We may use service providers who are strictly bound by our instructions and who support us, for example, in the areas of IT or the archiving and destruction of documents and with whom separate data processing agreementshave been concluded.
The privacy policy for the use of the "GoToMeeting" video conferencing software as part of the applicant selection process can be found here.
Your rights:
As a data subject, you have the right to information about the personal data concerning you (Art. 15 GDPR) and to rectification of inaccurate data (Art. 16 GDPR) or erasure if one of the reasons stated in Art. 17 GDPR applies, e.g. if the data is no longer required for the purposes pursued. You also have the right to restriction of processing if one of the conditions set out in Art. 18 GDPR applies and, in the cases set out in Art. 20 GDPR, the right to data portability. If the processing of data is based on your consent, you are entitled to withdraw your consent to the use of your personal data at any time in accordance with Art. 7 GDPR. Please note that the withdrawal only effects future processing. Any processing which took place before the withdrawal of your consent will not be affected. Please also note that we may have to retain certain data for a specific period of time in order to comply with legal requirements despite your withdrawal (see "Data erasure" for more information).
Right to object:
In cases where we process your personal data on the legal basis of Art. 6 para. 1 sentence 1 lit. e or f GDPR, you have the right to object at any time for reasons arising from your particular situation. We will then no longer process your personal data unless there are demonstrably compelling legitimate grounds for the processing that override your interests, rights and freedoms, or we need to process the personal information for the establishment, exercise or defense of legal claims.
Please contact datenschutz@telent.de for any questions relating to data protection law and to assert your rights as a data subject.
As a data subject, you also have the right to lodge a complaint with a supervisory authority if you believe that the processing of data concerning you violates data protection regulations. The right to lodge a complaint may be exercised in particular with a supervisory authority in the Member State of the data subject's habitual residence, place of work or place of the alleged infringement.
Automated decision making:
Since the decision on your employment relationship is not based exclusively on automated processing, no automated decision is made in individual cases within the meaning of Art. 22 GDPR.
